Simply Asking ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Service that are reported to our Designated Copyright Agent.

3. Filing a DMCA Takedown Notice
If you believe that content hosted on our Service infringes your copyright, please submit a written notification containing the following information:
3.1 Required Elements
Your DMCA takedown notice must include:
- Physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to have been infringed
- Identification of the infringing material with sufficient information to locate it (URLs, document titles, etc.)
- Your contact information including name, address, phone, and email
- A good faith belief statement that the use is not authorized by the copyright owner, its agent, or the law
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
4. Our Response to Valid Notices
Upon receipt of a valid DMCA takedown notice, we will:
- Acknowledge receipt within 24-48 hours
- Review the notice for DMCA compliance
- Remove or disable access to allegedly infringing material
- Notify the user who posted the content
- Provide the user with a copy of the takedown notice
- Inform the user of their right to file a counter-notification
5. Counter-Notification Procedure
If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification containing:
- Your physical or electronic signature
- Identification of the removed material and its former location
- A statement under penalty of perjury that you believe the material was removed by mistake or misidentification
- Your name, address, and telephone number
- Consent to jurisdiction of the appropriate Federal District Court
- Agreement to accept service of process from the original complainant
Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the material within 10-14 business days unless we receive notice of a court action.
6. Repeat Infringer Policy
In accordance with the DMCA, we maintain a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers:
- First offense: Warning and content removal
- Second offense: Temporary account suspension (7-30 days)
- Third offense: Permanent account termination
7. Misrepresentation Warning
Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
